Welcome to KiskSec. These Terms of Use ("Terms") govern your use of the KiskSec website and cyber readiness assessment tool (the "Service"), a community-benefit resource provided by Kisk. By using the Service, you agree to these Terms.

2. Nature of the Service

KiskSec is a free, non-binding, and informational tool designed to help small and micro-businesses in Canada understand their cyber readiness. It is not a security audit, certification, compliance assessment, or professional consulting service. The output ("Readiness Snapshot") is for internal informational purposes only.

3. No Professional Advice

The information provided by the Service does not constitute legal, financial, or cybersecurity advice. You are solely responsible for any decisions or actions you take based on the Readiness Snapshot. The Service is not a substitute for professional cybersecurity assessment or legal counsel.

4. User Responsibilities

You agree to use the Service responsibly and for its intended informational purpose. You are responsible for the accuracy of the information you provide during the self-assessment. You agree not to misuse the Service, attempt to disrupt its operation, or use it for any unlawful purpose.

5. Data and Privacy

Your privacy is paramount. As detailed in our Privacy Policy, the Service is designed to be privacy-respecting. It does not require, collect, or store any personal data or sensitive business information to generate a Readiness Snapshot. Participation is anonymous.

6. Limitation of Liability

The Service is provided "as is" and "as available" without any warranties, express or implied. To the fullest extent permitted by law, Kisk, its operators, and affiliates disclaim all liability for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use or inability to use the Service or reliance on its output.

7. Intellectual Property

The Kisk and KiskSec names, logos, and the content and structure of the Service are the property of Kisk. You may not use them without permission. The Readiness Snapshot is for your internal use.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of New Brunswick.

9. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by posting the new Terms on this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
